Parking Fine in England

I was staying at the Travelodge at Tamworth services on the M42 a few weeks ago, i arrived at 23:00 and left at 09:00 the following morning and was advised at reception it was free parking and gave her my numberplate.

I have now been given a parking fine of £100 for overstaying the 2 hour free parking period by a company called CP Plus.

Do i just ignore?

No. Phone/Write to Travelodge and the parking company, explain the situation. You can be made to pay.

Was it well sign posted that only "so-and-so" hours of free parking was allowed?

On the surface you should just ignore this, as companies like CP Plus are in no position hand out fines, and will not be worth their time or money to take further action, but I have read that one or two of these companies have found loop holes where the final can be be "legal"..... maybe best to phone the hotel and explain what has happened.

Shocking advice. As long as signposting was adequate and clear, by parking you are accepting the T's and C's of doing so and this forms a contract. The supreme court have ruled on this after a guy tried to challenge the fine, arguing that it was a "penalty" and therefore unenforceable.

@hannibal smith Do not just ignore these. I'd think the company would be reasonable about it and let you off but if you ignore, they'll pursue and you'll have to pay.

I didn't really notice any signs, it was late at night and i had been on the road for 6 hours with two young impatient kids. 

I was photographed going in and out of the service station, i had parked in the Travelodge car park.

@hannibal smith Do not just ignore these. I'd think the company would be reasonable about it and let you off but if you ignore, they'll pursue and you'll have to pay. 

I guess the agreement would be with the driver - and you "don't know" who the driver was - or you self incriminate, and should ask for photographs to identify who driver was

You've done the right thing. Contact the hotel and ask them to sort it. They will get these all the time. Can probably send an email and get it cancelled.

If you don't pay, the parking company pass it to a debt recovery company, and then they can't help you.

Unfortunately ours got sent to the wrong address*, so the first we heard was from the debt recovery company, so the cinema we were visiting can't help. So just ignoring it, and hoping they don't bother taking it further.

*despite telling us we only had to tell them once we had moved, the DVLA had our car registered at old address.

The law has definitely shifted on this in the last year or two, but the landowners, or main land occupants generally still have the authority to cancel them. I'd start by going down the 'good customer' route & see what they say.

There's a dedicated civil ticket forum where there a good number of specialists in this to advise you. 100% though, don't ignore it & don't tell them who was driving at this stage (including not mentioning it on the forum).

This is the best advice in the thread. Do as he says. You'll likely end up appealing via POPLA once the company routinely reject your appeal, but should be successful in the end.

And ALWAYS refer to "the driver" not "me" or "I" etc. Even on the forum.

The pepipoo forum website it excellent - follow their advice to the letter.

Not do long ago you could simply ignore these invoices (that is all these "fines" are, nothing more than a request for payment) but this has started changing in recent times.
